EU Council and Parliament Reach Provisional Agreement on Modernized Child Sexual Abuse Laws

The Cyprus Presidency of the EU Council, in collaboration with representatives from the European Parliament, announced a provisional agreement today concerning the modernization of EU criminal law regulations pertaining to child sexual abuse and exploitation. The agreement addresses evolving threats within the digital landscape. A key element of the new rules establishes criminal penalties for the payment of access to live broadcasts featuring child sexual abuse.

Furthermore, the creation or modification of artificial intelligence systems specifically designed for the generation and distribution of such material will also be subject to prosecution. Officials cited the rising prevalence of “deep fakes”—artificially created child sexual abuse material—as a primary driver for this legislative update. The revised regulations will extend to encompass the possession and distribution of instructional materials related to child sexual abuse, including printed books and online content.

The Council emphasized the importance of adapting existing legal frameworks to combat this increasingly sophisticated form of exploitation. The provisional agreement now moves to further scrutiny and final approval stages.
