Spanish court: Kissing without consent is a sexual assault

The Spanish Supreme Court recently addressed a case originating in 2023 involving an incident at a Madrid bus station. A man approached a woman, initiating contact without her permission. He kissed her hand and then urged her to accompany him, subtly suggesting a financial payment.

As reported by the BBC, a previous court had convicted him of sexual assault, imposing a fine of 1,620 euros – a decision subsequently upheld by the Madrid regional court. The defendant’s legal team argued that the situation lacked violence or intimidation, emphasizing that the event occurred in a public and secure location during daylight hours. They contended that the actions constituted harassment rather than a more serious offense.

However, the court rejected these claims, highlighting the clear sexual nature of the interaction. The judges determined that the physical contact, occurring without her consent, was a significant factor. Crucially, the court’s judgment stated that her consent was not a prerequisite for pursuing the case against him.

The court ultimately affirmed the original conviction, underscoring the importance of respecting personal boundaries.
