New Act Defines Single-Parent Family Status for Child Maintenance Purposes

A new law, the Novel Act on parental care and family benefits, will take effect today, revising the criteria for determining whether a child lives in a single-parent family regarding maintenance contributions. The Ministry of Labour, Family, Social Affairs and Equal Opportunities established these guidelines during the time of Robert Golob’s government. The act defines a single-parent family when a child actually receives insufficient maintenance or when the other parent’s contribution falls below the level required to meet the child’s basic needs.

This shift in definition aims to ensure a more accurate assessment of family circumstances. However, the Novel Act does not include provisions for increased child allowances based on preschool attendance. Specifically, the legislation does not address a potential increase in child’s allowance for children under four who do not attend kindergarten.

The focus of the new law remains on ensuring adequate maintenance for the child, with the determination of whether a family is considered single-parent dependent on the actual level of parental contribution. The act’s implementation marks a change in how the government assesses support for families and their children.
