Furs established issuing decisions on the levying of monetary social assistance

The Constitutional Court suspended the enforcement of Article 8 of the Emergency Measures Act for Public Security on Thursday, pending a final decision. This article, often referred to as “Šutar’s law,” allows for tax enforcement on cash social assistance payments. The court’s decision followed an initiative filed by the Ombudsman and nine individuals seeking to determine the constitutionality of the regulation.

The Legal Network for the Protection of Democracy assisted in filing the initiative, which included four adult and five child initiators. In reaching its decision, the Constitutional Court stated that it carefully considered the potential detrimental effects of both continuing the enforcement of Article 8 and the temporary suspension. The court’s action reflects a thorough assessment of the possible ramifications associated with the regulation’s application.

The initiative is currently under review, and the Constitutional Court will issue a final ruling on the article’s legality.
