Pirin: The protection of Nataša Pirc Musar is unlawful

During a discussion on the 24UR program Tonight, Dr. Rajko Pirnat of the Ljubljana Faculty of Law asserted that the legal basis for the protection of the president remains governed by specific statutory provisions. He noted that Article 6 of the Law on ensuring conditions for the work of the president of the Republic has stipulated that the president is to be secured by the police since 2003.

According to Dr. Pirnat, this foundational law remains legally paramount over any subsequent administrative directives. The expert pointed out that while regulations have since been issued, they have sometimes deviated from the established legal framework.

He critiqued previous attempts by administrations to implement alternative protection measures, arguing that these actions were inconsistent with the primary statute detailing the powers of the police. He emphasized that the existing law provides a clear guarantee regarding the necessary level of protection. Furthermore, the recent order issued by the Janša government concerning the president’s security reinforces this legal standing.

This order explicitly mandates that the protection of the president must be furnished by the police force, thereby aligning the administrative action with the existing statute. Dr. Pirnat concluded that any regulation contradicting the explicit terms of the foundational law governing the president’s role is legally questionable.

The core argument centers on the supremacy of the initial legislative mandate over evolving governmental decrees regarding security protocols.
