Mol Disputes Continued with Croatia Over Gas Trading Agreement

The longstanding dispute between MOL and the Croatian government continues following a significant court ruling. MOL has repeatedly asserted that Croatia failed to uphold its obligations under the gas agreement established in early 2009. This agreement mandated the Croatian state’s assumption of gas trading activities from INA.

The core of the dispute stems from significant financial losses experienced on the Croatian gas market due to regulated pricing and low gas volumes at the time. MOL initiated a large investment arbitration against Croatia in 2013, bringing the case before the International Center for Settlement of Investment Disputes (ICSID) in Washington. In 2022, the ICSID ruled against MOL, ordering the company to pay over $200 million, including accrued interest and legal costs.

However, the court partially dismissed MOL’s claims, determining certain aspects required resolution through a separate arbitration process. The case centers on the complex dynamics of gas trading and the interpretation of the 2009 agreement between MOL and the Croatian government.
