Mitja Kocjančič Found Aware During Sentencing Following Murder Trial
A five-member court, presided over by Judge Nine Prosen, has concluded its assessment of Mitja Kocjančič in connection with the death of his wife. The judge determined that Kocjančič was fully aware of his actions and their potential consequences. During the proceedings, Judge Prosen stated that Kocjančič intentionally attacked his wife while she was in bed, with the direct intent to cause her death.
The sentencing decision considered several factors, including Kocjančič’s prior lack of criminal record and the circumstances surrounding the act. The court acknowledged that the offense occurred within a state of significantly diminished culpability. Furthermore, the court noted that the victim’s behavior played a contributing role in the events leading up to the incident.
As a result of these considerations, the court extended Kocjančič’s detention, citing a continued risk of recurrence. The prosecutor, Vesna Primožič, had initially requested a sentence of 14 years imprisonment for the murder offense, proposing a range of five to fifteen years. The court ultimately delivered a sentence that falls within the proposed range.
