PKC: The positions of secretary and mayor are incompatible. Jaklin does not resign

Investigations are currently underway concerning allegations of misconduct, including abuse of official position, acceptance of bribes, and money laundering related to the construction of the Mura water supply. Parallel to these proceedings, a separate question has arisen regarding the appropriateness of Damjan Jaklin simultaneously holding the roles of State Secretary and the unpaid mayor of Velika Polana. The Commission for the Prevention of Corruption (KPK) informed media outlets that it has recently updated its guidelines concerning the permissible holding of multiple public functions.

The KPK emphasized that any conflict of functions must be evaluated based on an individual’s primary or professional capacity. Specifically, the Commission stated that State Secretaries, given their status as professional functionaries, are generally prohibited from concurrently serving as vice-mayors or municipal council members. Extending this precedent, the KPK indicated that the role of the mayor of Velika Polana falls under this category of incompatible duties.

This regulatory clarification establishes a clear professional boundary for individuals serving in the capacity of a secretary within the state apparatus. The guidelines suggest that maintaining multiple concurrent positions, particularly those spanning high-level state service and local municipal leadership, requires careful adherence to established incompatibility rules.
