The Ljubljana District Court confirmed today that the indictment against Dušan Smode in the Fotopub case became final on March 11th, and that a preliminary hearing was scheduled for June 3rd. The prosecution filed the indictment accusing Smode of criminal offenses of sexual assault, providing for the use of prohibited drugs, and physical injury on February 28th, 2011. They were unable to file the indictment a year later.
Dušan Smodej has been in custody since January this year. The indictment was handed down at the beginning of March, but he objected to it. The district court explained at the beginning of March that the objection would be decided by the out-of-court senate of the court.
