Contradictory interests in culture: directors through copyrights to fees

The KPK has identified a potentially problematic practice, raising concerns regarding breaches of conflicts of interests under the Act on Integrity and Prevention of Corruption (ZIntPK). Consequently, the Commission strongly advises the Ministry to develop comprehensive guidelines for public institutions. The issue stems from several ongoing complaints, either recently received or still under investigation, alleging that individual directors within public institutions, fulfilling management roles, are involved in co-authoring agreements.

These collaborations, while not explicitly forbidden by law, frequently originate from artistic programs where these directors actively participate. It’s crucial to recognize that the provisions of ZIntPK extend to directors of public cultural institutions. Therefore, they must adhere to the same standards and operate through co-authoring agreements.

This situation demands careful consideration of potential interests and ensures transparency. The commission emphasizes the need for clear protocols to safeguard against any perceived conflicts. The directors involved must understand and comply with the regulations, reinforcing ethical conduct within these institutions.
