New executive orders have been issued that impose restrictions on acquiring U.S. citizenship, reportedly exceeding the scope of previous legislative attempts. According to reports, the first directive addresses the eligibility of children born to U.S.
officials whose connections are deemed problematic. Specifically, the order stipulates that children whose parents are classified as foreign enemies, members of foreign terrorist organizations, or individuals employed by foreign governments would not qualify for citizenship at birth. The second executive order targets the practice known as “birth tourism.” This practice involves pregnant women traveling to the United States with the primary intent of securing U.S.
citizenship for their child immediately following birth. Current U.S. law already contains provisions that prohibit the issuance of a visa if the main purpose of the trip is established as obtaining citizenship for a child born domestically.
Consequently, the mechanism by which this new order intends to further restrict existing regulations remains unclear. These measures represent a significant tightening of immigration policy concerning lineage and intent. The rules establish new criteria for determining eligibility for citizenship at birth, particularly concerning the parental ties to foreign entities or adversaries.
